These Terms and Conditions of Service (hereinafter, the "Terms") govern the access, use, and transactions carried out through the website www.kikai-world.com (hereinafter, the "Site"), owned and operated by KIKAI.
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Site.

2. Acceptance of Terms
By using our Site, you confirm that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Site. You also agree that all information you provide is true, accurate, and complete.
3. Products and Services
KIKAI specializes in the sale of authentic collectible items. All products are subject to availability. We reserve the right to limit the sales of our products or services to any person, geographic region, or jurisdiction. We reserve the right to discontinue any product at any time.
While we strive for accuracy, the colors and images of products on the Site may vary slightly due to monitor settings or photographic lighting. For used or vintage items, KIKAI provides a comprehensive and detailed description of their condition, including any wear, defects, or relevant historical particularities. Real, high-quality photographs of the specific item to be shipped will be included. By making a purchase, the Customer acknowledges having reviewed the photographs and product description, understanding its condition and characteristics. The Customer is invited to contact KIKAI before making a purchase if they have any doubts, need more photographs, or require additional information about the item.
Products designed and produced directly by KIKAI (including, but not limited to, hoodies, t-shirts, and tote bags) are tribute and curatorial design pieces and are not official licensed merchandise from the trademark holders they reference. The Customer purchases a KIKAI exclusive design piece and accepts that the reference images are covered by the Fair Use clause (mentioned in the Legal Notice) and are used as a tribute to pop culture.
4. Pricing and Payments
All prices displayed on the Site are in United States Dollars (USD) and are subject to change without prior notice.
Important Note on Pricing Differences: As a global business operating from Mexico and serving various international markets, it is important to clarify that the prices of our products may vary between our international site (with prices in US Dollars) and our Mexican site (with prices in Mexican Pesos). These differences are due to several factors inherent in international trade and the specific characteristics of each market, including operational and logistics costs, market dynamics, and currency fluctuations. Our prices are carefully calculated to ensure we can continue to offer the authenticity and quality that characterizes us, covering the costs associated with each operation. We appreciate your understanding and loyalty.
Payments are processed securely through third-party payment gateways (e.g., PayPal). By making a purchase, you agree to the terms and conditions of these payment processors. KIKAI does not store your credit card or payment information. All sales are final once payment is confirmed, subject only to our explicitly stated Return and Refund Policy.
5. Shipping and Delivery
Shipping Costs: Shipping costs will be calculated and displayed at checkout.
International Shipping: KIKAI offers international shipping to various countries. However, we reserve the right to not ship to certain destinations.
Responsibility for Delivery: KIKAI's responsibility for the product ceases once the package is accepted by and delivered to the designated shipping carrier and a valid tracking number is provided to the customer. We are not responsible for delays, damages, losses, theft, or non-delivery of packages incurred during transit or after delivery confirmation by the carrier. Customers are solely responsible for tracking their packages using the provided tracking number and for filing claims directly with the shipping carrier for any transit-related issues, including but not limited to lost or damaged items, or confirmed deliveries not received. While KIKAI commits to securely packing products, we do not assume liability for carrier performance.
Customer Assistance (Added for clarity): Notwithstanding the above, in the event of an incident with the shipping carrier (e.g., damage, loss, delay), KIKAI commits to provide reasonable assistance to the Customer, within our control and capabilities, in the process of initiating and following up on their claim directly with the shipping carrier. This assistance is aimed at facilitating communication and resolution, but it does not imply the assumption of direct responsibility by KIKAI for the incident.
Shipping Insurance: Standard shipping services may include a basic level of carrier insurance. If the Customer desires additional shipping insurance for a higher coverage value of their purchase, they must explicitly request it before completing their order and agree to cover the additional cost as determined by the shipping carrier or external insurance provider. Failure to purchase additional insurance means the customer accepts the basic coverage limitations of the chosen carrier.
Customs, Duties, and Taxes: International orders may be subject to customs duties, import taxes, and fees levied by the destination country. These charges are the sole responsibility of the buyer and are not included in the product price or shipping cost. KIKAI has no control over these charges and cannot predict what they may be. Please check with your local customs office for more information before placing an order. Refusal to pay these charges by the customer will result in the package being returned to KIKAI or abandoned, and in such cases, no refund will be issued for the product or shipping costs.
6. Returns and Refunds
Our Return and Refund Policy is incorporated into these Terms by reference. Please review our separate Refund Policy for detailed information on eligibility, process, and conditions for returns and refunds. KIKAI reserves the right to deny any return or refund request that does not strictly adhere to the terms outlined in our Return and Refund Policy.
Returns of KIKAI Exclusive Design Items (Hoodies, etc.): As these items are often manufactured upon request or in very limited runs, we do not accept returns for changes in size, color, or buyer's remorse. Returns will only be accepted for verifiable defects in the print or manufacturing of the item, reported within 48 hours of receiving the package, with photographic and video evidence provided.
7. Dispute Resolution and Chargebacks
In the event a Customer initiates a payment dispute (chargeback) through their bank or payment gateway, KIKAI reserves the right to vigorously appeal such dispute if we determine that the claim does not comply with these Terms and Conditions or our Return and Refund Policy. We highly encourage the Customer to contact KIKAI directly at kikaiworld_mx@outlook.com to seek clarification or express any dissatisfaction before initiating a chargeback process with a third party, in order to seek an amicable and faster resolution. Any chargeback initiated contrary to our stated policies may result in the customer being permanently banned from future purchases on our Site.
8. Intellectual Property
All intellectual property rights and industrial property rights of the content and visual elements of the Site (including, but not limited to, texts, images, photographs, graphics, designs, logos, icons, buttons, software, and any other sign susceptible of industrial and commercial use) are owned by KIKAI.
Images, trade names, trademarks, characters, and any other intellectual property related to the products offered for sale on this Site belong to their legitimate creators and rights holders. KIKAI commercializes these products as authentic imported items and does not claim any intellectual property over them, nor does it possess a direct licensing, sponsorship, or affiliation relationship with their holders.
The "KIKAI" brand and its logo design are the exclusive property of KIKAI.
It is strictly prohibited to reproduce, transform, distribute, publicly communicate, make available, extract, reuse, resend, or use in any nature, by any means or procedure, any of the elements of the Site, unless legally permitted or expressly authorized by the corresponding rights holder.
9. User Conduct
You agree not to use the Site for any unlawful purpose or any purpose prohibited by these Terms. You agree not to damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site.
10. Disclaimer of Warranties; Limitation of Liability
KIKAI does not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.
11. Indemnification
You agree to indemnify, defend and hold harmless KIKAI and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
12. Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
13. Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our Site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
14. Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this Site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). 15. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of Mexico City, Mexico. Any disputes arising from or in connection with the use of the Site or these Terms shall be subject to the exclusive jurisdiction of the competent courts of Mexico City, Mexico, and you hereby expressly consent to the personal jurisdiction and venue of such courts, waiving any other jurisdiction that may correspond to you by reason of your current or future domicile.

KIKAI reserves the right to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
